The Agriculture Improvement Act of 2018 is the foundation of hemp legality in the United States. Here's what it means for THCA.
The 2018 Farm Bill defines hemp as Cannabis sativa L. with a Delta-9 THC concentration of no more than 0.3% on a dry weight basis. THCA is a distinct, non-psychoactive cannabinoid that is federally legal when sourced from compliant hemp.
Under the 2018 Agriculture Improvement Act, hemp and its derivatives — including THCA — were removed from the Controlled Substances Act. This means hemp-derived THCA is federally legal when the plant material tests below 0.3% Delta-9 THC.

The Science
THCA (Tetrahydrocannabinolic Acid) is the acidic precursor to Delta-9 THC. In its raw, unheated state, THCA does not bind to CB1 receptors and does not produce intoxicating effects.
When exposed to heat — through smoking, vaping, or cooking — THCA loses its carboxyl group and converts to Delta-9 THC. This process is called decarboxylation and is what activates the compound.
Because THCA is chemically distinct from Delta-9 THC, it is not classified as a controlled substance under federal law when derived from compliant hemp. The 0.3% limit applies to Delta-9 THC — not THCA.
